Healthcare Providers Settle Lawsuits Over Improper Patient Data Sharing

In a significant legal development, two healthcare providers have reached settlements in class action lawsuits alleging improper sharing of patient information with technology companies via website tracking pixels. Fairchild Medical Center, located in Yreka, California, and Boone Health, based in Columbia, Missouri, both faced complaints centered around their use of tools such as Meta Pixel and Google Analytics. These tools reportedly transmitted sensitive patient data to third parties without obtaining proper consent or providing notification to the patients involved.

The legal troubles for Fairchild Medical Center began with a lawsuit filed in Siskiyou County Superior Court. This lawsuit claimed violations of several California privacy laws, including the California Confidentiality of Medical Information Act and the state’s Invasion of Privacy Act. It further alleged negligence, breach of fiduciary duty, and invasion of privacy. Boone Health encountered a similar situation when a lawsuit was lodged against it in December 2022. This case, later refiled with additional plaintiffs in Cole County Circuit Court, specifically examined the data collection practices concerning patients who logged into the hospital’s patient portal between April 2021 and December 2022.

In response to the allegations, both healthcare organizations have maintained their innocence, asserting that they did not violate patient privacy laws. Fairchild Medical Center explicitly stated that it disagrees with all claims made in the lawsuit. Meanwhile, Boone Health initially sought to have the case dismissed through a motion, but this attempt was rejected by the court. Despite their denials, both providers opted to settle, aiming to avoid the extensive costs, time commitments, and uncertainties associated with prolonged litigation and potential appeals.

The settlements reached by Fairchild Medical Center and Boone Health cater to different patient populations and provide varying compensation levels. Specifically, the settlement involving Fairchild Medical Center covers approximately 1,000 California residents and includes a one-time payment of $25 for each class member. In addition, participants will gain complimentary enrollment in a one-year CyEx Privacy Shield Pro membership, which aims to enhance their online privacy and security.

Boone Health’s settlement pertains to Missouri residents who accessed the patient portal during the defined timeframe, offering a cash payment of $20 alongside a 12-month membership to the same identity protection service. This approach highlights the growing concern surrounding patient data security and the need for healthcare organizations to implement robust privacy protections when utilizing third-party analytics tools.

Affected patients from Fairchild Medical Center must file claims by November 2, 2026, with a final court approval hearing scheduled for October 15, 2026. In contrast, patients impacted by Boone Health will have a claims deadline of November 9, 2026, coinciding with the date by which any objections must also be submitted. A final fairness hearing for Boone Health’s settlement is set for December 1, 2026.

This incident serves as a crucial reminder for healthcare providers to critically review their website tracking implementations to ensure compliance with patient privacy regulations. Organizations must obtain proper consent before deploying third-party analytics tools that may capture protected health information. As technology continues to evolve, the healthcare sector must remain vigilant in safeguarding patient data against potential breaches and unauthorized disclosures.

The settlements underscore a broader trend in which patient privacy rights are increasingly being scrutinized as more organizations leverage technology to enhance operational efficiency.
