Delta Air Lines has decided to take legal action against cybersecurity firm CrowdStrike and tech giant Microsoft with the help of David Boies, chairman of Boies Schiller Flexner. This move comes in response to a catastrophic system crash on July 19 that resulted in the cancellation of thousands of flights and left millions of computers offline.

The system crash caused by a software update from CrowdStrike that affected Microsoft systems has resulted in significant financial losses for Delta. The airline estimates that the cost of the outage falls between $350 million and $500 million. Following the cancellation of nearly 7,000 flights, Delta received over 176,000 refund or reimbursement requests from affected passengers.

The involvement of David Boies, a prominent figure known for his involvement in high-profile legal cases, sends a strong signal that Delta is serious about seeking compensation for the damages incurred. Boies has a strong track record, having represented the U.S. government in the antitrust case against Microsoft and played key roles in other major legal battles.

The announcement of Boies’ involvement caused a sharp decline in CrowdStrike’s stock, leading to a 5% drop in extended trading. On the other hand, Microsoft’s shares remained stable amidst the news.

Apart from seeking damages from CrowdStrike and Microsoft, Delta is also facing investigations from the Department of Transportation regarding its handling of the disruptions that caused widespread service failures across the airline industry. The broader impact of the outage has been significant, with insurance startup Parametrix estimating a total loss of $5.4 billion for Fortune 500 companies, excluding Microsoft.

While no lawsuit has been officially filed yet, Delta’s intention to pursue legal action indicates the severity of the incident. The potential implications of this lawsuit could be far-reaching for CrowdStrike and Microsoft as they navigate the fallout from the system failure. Industry observers will be closely monitoring how Delta, CrowdStrike, and Microsoft address the legal and financial challenges ahead.

As the situation continues to develop, it remains to be seen how Delta will move forward with its legal action and what repercussions CrowdStrike and Microsoft will face as a result. The involvement of a legal heavyweight like David Boies underscores the seriousness of the situation and sets the stage for a potentially contentious legal battle. Stay tuned for updates as the case unfolds.
