UK CMA Approves Amazon, Anthropic Collaboration

The U.K. Competition and Markets Authority has decided to call off its investigation into the $4 billion deal between Amazon and Anthropic, an artificial intelligence firm based in San Francisco. The deal, which took place in March, involved Amazon making a significant investment in Anthropic, with Amazon Web Services being designated as the primary cloud provider for Anthropic’s mission-critical workloads.

When the U.K. CMA launched its probe in August, it was specifically looking into whether the deal constituted a “relevant merger situation” and whether Amazon would have substantial influence over Anthropic as a result of the partnership. However, the authority has determined that Anthropic’s annual revenue in the United Kingdom is less than £70 million and it accounts for less than a quarter of the market, falling below the threshold for further investigation under the Enterprise Act 2002.

Despite clearing the Amazon-Anthropic deal, the U.K. CMA is still considering whether to deepen its probe into another partnership involving Anthropic and Alphabet Inc., Google’s parent company. The authority is paying close attention to big tech firms like Google, Amazon, Microsoft, Meta, and Apple, collectively known as the GAMMA firms, which have a dominant presence in the compute and data resources market and may potentially obstruct new entrants.

According to Sarah Cardell, head of the U.K. CMA, the AI market has a “winner takes all” dynamic, with larger firms using their market power to impede competition. In a similar vein, the U.K. CMA launched an investigation last year into Microsoft’s $13 billion investments in OpenAI, a generative AI model maker, over concerns of anti-competitive behavior.

Overall, the U.K. CMA’s decision to clear the Amazon-Anthropic deal underscores the complexities and challenges surrounding partnerships in the AI industry, especially when it comes to assessing competition and market dynamics. As technology continues to evolve at a rapid pace, regulators will play a crucial role in ensuring fair competition and innovation within the AI sector.
